Welcome to the “Ajmal Zafaf” platform.
Introduction
“Ajmal Zafaf” is an online platform that links parties looking for wedding services. The platform operates as a mediator between clients’ “Grooms” on the one hand and local wedding planners and wedding service providers on the other to organize events and handle all of their arrangements. The platform provides services to clients and service providers under the following terms and conditions:

First: Definitions
In this Agreement, unless the context indicates otherwise, the following terms shall have the meanings given.
“Ajmal Zafaf,” “The Platform,” “We,” “Us” or “Our” refer to the application “Ajmal Zafaf” and the website www.Ajmalzafaf.com in the Kingdom of Saudi Arabia.
“User,” or “you,” refers to anyone who visits or uses the Ajmal Zafaf platform in any form, whether as a service provider, Client or otherwise.
“Products” and/or “Services” refer to any products and/or services offered through the Platform by the Service Providers which the Client can order directly from the Service Provider.
“Service Provider” refers to any individual, group, business, or another service provider who registers on the Ajmal Zafaf platform and uses it to advertise their services and goods.
“Client” refers to any person who views the Services and Products offered by the Service Providers via the Platform and/or communicates with the Service Providers about any such Services or Products.
“Content” refers to all text, Information, Data, Photos, Logos, Videos, ads, and anything else posted by the User via the Ajmal Zafaf platform.
“Agreement” refers to the terms and conditions, service and product policies, privacy policy, all pages of the Ajmal Zafaf platform (main and subsidiary), the description of services, all information, the content of services, all instructions, and special agreements made between the Ajmal Zafaf platform on the one hand and any of the Ajmal Zafaf platform’s users on the other, as well as the contracts associated with the terms and conditions.
“Contract” refers to the contract entered into between the Ajmal Zafaf platform on the one hand and the Service Provider on the other, which contains special terms that supplement the requirements of this Agreement.
“Regulations” or “Laws” refer to the regulations in force in the Kingdom of Saudi Arabia.
Second: Legal Capacity
(1) The “Ajmal Zafaf” platform requires users to be at least 18 years old. The user of the Ajmal Zafaf platform is required to have the legal capacity to enter into contracts, and we are not responsible for validating the eligibility of any site users.
(2) If you are under the age of 18, you may only use the services of the Ajmal Zafaf platform under the supervision of a parent or guardian, without limiting any other rights to the “Ajmal Zafaf” location under this Agreement or the law. The Ajmal Zafaf platform reserves the right to limit your access to the Ajmal Zafaf platform or to cancel your membership if it determines that you have not attained the age of 18.
(3) The commercial entities registered on the Platform are required to possess all essential licenses to operate legally and deliver their services. The Agreement shall end for any Service Provider whose licenses expire.
Third: Approval
(1) You represent that you have the legal capacity to engage in and agree to this Agreement and that you have full unrestricted legal powers under the terms of this Agreement.
(2) By using the services of the “Ajmal Zafaf” platform, you agree to this Agreement and acknowledge that you are legally bound by the terms and conditions set out herein or its modifications.
(3) By registering as a business entity, you agree that you have the authority to bind that entity to this User Agreement and that both you and the business entity you represent will be subject to all applicable online trading regulations.
Fourth: The Legality of the Agreement
(1) This Agreement constitutes the entire and only agreement between the “Ajmal Zafaf” Platform on the one hand, and visitors to or users of the platform and its features, on the other.
(2) This Agreement is a valid contract with full legal conditions and pillars, binding on all of the parties mentioned, and no one may deviate from or cancel it as long as it produces its legal consequences.
(3) The parties acknowledge that this Agreement comprises the entire agreement between the parties, and the parties hereto agree that they rely on no representations, oral or written, in executing this Agreement other than the provisions forth in this Agreement.
(4) The description of the Services and the sub-pages of the Ajmal Zafaf Platform prepared by the “Ajmal Zafaf” Platform are an integral part of this Agreement.
(5) Amendments to this Convention shall have the same provisions and legal effect as this Convention.
Fifth: Privacy and Confidentiality
(1) Data collection and processing are governed by the Platform-approved Privacy Policy, which is an integral part of the Terms and Conditions.
(2) The User is obligated to maintain the privacy of any Platform internal business dealings, financial reports, commissions, fees, employee data, and any other information or data that are generated with a specific recipient in mind or that are not intended for general distribution.
(3) The User shall only use the data to deliver or utilize the Services; they shall not collect or otherwise make use of any data belonging to any third parties who use the Platform, such as customers, merchants, or service providers.
(4) The Platform shall maintain the confidentiality of all information you have provided to us or that relates to your use of the Platform. This information may only be viewed by our staff, service providers, and other third parties who need to know about the data, are permitted to access the data by the User or the Platform or are involved in a transaction that allows such access.
Sixth: Legal Extent of Our Services
(1) The Ajmal Zafaf platform serves as an online intermediary between service providers and clients, and our responsibility is limited to connecting the client to the service provider so that the Client can acquire the advertised services and products. We do not accept responsibility for the communications of Clients with service providers.
(2) The platform of the Ajmal Zafaf does not apply to any provisions of the Labor Law, agency, sponsorship or other legal provisions related to legal responsibility for the acts of affiliates or third parties. You agree on the nature of this work and our role and deal through the platform of Ajmal Zafaf in this sense.
Seventh: Digital Signature
(1) In the case of services that necessitate registration: by registering for an account on the Ajmal Zafaf platform, or by clicking to accept the terms of service when requested on the Ajmal Zafaf platform, you are deemed to have executed this Agreement and the other terms of service electronically and are legally valid in your experience from the date of registration of your account or from the date of clicking to accept the terms of service.
(2) For service that does not require Sign up: Your use of such Services constitutes your affirmative consent to the terms and conditions set out above and all other policies and is legally binding upon you as of the date of such usage.
Eighth: Sign Up/ Membership Registration
(1) Service Provider Registration and Membership:
- All official documents, such as a license, a business register entry, and/or Service Provider data, that are required by the Platform’s management must be provided by the Service Provider.
- The service provider is legally obligated to all governmental and non-governmental entities and individuals for any data or documents provided by him via the platform.
- The service provider must register under his commercial name (company name, organization name) and commit not to use any aliases or fake names, and the image of his account on the site reflects his commercial identity.
- The service provider is registered with the Ajmal Zafaf platform by submitting an application to join the Ajmal Zafaf platform, which includes the following data: (Username, Email, Password, Location of the Service Provider, Phone Number, Description of services, Social Networking Pages).
- All official documents and data submitted by the service provider must be reviewed by the platform’s management, and we reserve the option to approve or reject a registration on the platform. Membership will be registered as soon as the management of the Ajmal Zafaf platform accepts it after verifying all data and documents given by the service provider.
- Membership on the platform is not free, and service providers must follow the platform’s cost and subscription policy.
(2) Clients Membership Registration:
- The client shall register his or her real name and not use any false or deceptive name.
- The client must provide us with membership form data, which may include but is not limited to (username, email, and password).
- Site membership is free and direct for clients and does not need to be reviewed by the Ajmal Zafaf platform’s management.
- When you register as a person, you solely represent yourself; the account is based on personal preference.
Ninth: Acceptable Use Policy (AUP)
(1) The services of the Ajmal Zafaf platform are only available in the Kingdom of Saudi Arabia, and we are not obligated to provide services in any other country, even though you can access the Ajmal Zafaf platform from anywhere in the globe.
(2) You undertake to follow the instructions on the Ajmal Zafaf platform regarding your account, including how to use the account or additional services, as well as all usage precautions.
(3) You undertake to provide any data or documents requested by the Ajmal Zafaf platform at any time, whether while joining us and registering your account or while providing services to you after registering your account.
(4) The User acknowledges and agrees to be accurate when entering the information required to be entered into the Ajmal Zafaf platform, and agrees to review that information regularly to correct, amend, or renew it whenever new information becomes available, as long as He keeps all relevant data and documentation.
(5) All information you provide must be accurate, up-to-date, correct, and in line with the requirements of our registration form.
(6) If you provide incorrect, inaccurate, unsynchronized, or incomplete information, or if we have reasonable grounds to suspect that such information is inexact, unsynchronized, or incomplete, or not under this Usage Agreement, we will suspend or cancel your membership, without prejudice to any other rights under this Agreement or the law.
(7) The User undertakes to preserve confidential information about his Accounts, such as his Username and Password and takes full responsibility for any disclosure of such information to third parties as well as any use made by anyone to whom he has revealed such confidential information.
(8) The user undertakes to promptly notify the platform of Ajmal Zafaf if his account is hacked or if he discovers any illegal use of his account on the Ajmal Zafaf platform so that we can take the required technical steps to safeguard the account.
(9) You shall not use someone else’s account at any time without the expressed consent from the “Ajmal Zafaf” platform.
(10) The User shall alert us if he discovers any illegal use of the Platform, Services, or payment cards.
(11) We reserve the right to cancel accounts that have not been confirmed or dormant for a long time.
Tenth: Supply Policy
The platform allows service providers to publish advertisements electronically via us, and the process of publishing advertisements is subject to the following conditions:
(1) The Platform is an online platform through which the Service Provider can publish its own advertisements, and our role is limited to providing the Platform technically. The Platform does not interfere in any way with the content of advertisements or the provision of advertised services or products.
(2) The advertisements must be legal and in line with this Agreement and applicable laws, and they must include all of the material data of the advertised product or service, and such data and prices must be identical, and the service or product advertised must be legal and not prohibited from being sold, leased, traded, or possessed.
(3) The Client understands that any offers, discounts, and pricing made available through the Platform are for service providers and that the Platform has no say in deciding prices or offering discounts and offers.
(4) The Client is aware that the Products are provided by the Service Provider and that the Platform does not offer any such Products and that its role is restricted to delivering content and links.
(5) The advertisement shall not violate any third-party rights, such as intellectual property rights, privacy rights, trade rights, trademarks, or other rights of their owners.
(6) The advertisement is shown by the platform’s specifications. The Service Provider grants us permission to view and share the Content it has made available through the Platform. The Service Provider acknowledges that it has full authority to post the Content on the Platform and that such Content does not violate any third-party rights. We reserve the right to include the name “Ajmal Zafaf” in any advertisement you post on the site at any time.
(7) The Platform reserves the right to remove any advertisement published by the Service Provider via the Platform at any time if we feel that such content violates the third-party intellectual property, trademark, privacy, trade, or other proprietary rights.
(8) The Service Provider shall bear all legal liabilities if He infringes on any personal or intellectual property rights in any Content it publishes via the Platform.
(9) The “Ajmal Zafaf” platform is neither an information content provider nor is it considered a publisher of any content uploaded or via any communication tool available on the platform.
(10) In all cases, the Service Provider shall bear all legal consequences, damages, and liability if the advertisement infringes any third-party rights, relevant laws, or the terms of this Agreement.
(11) The platform makes all data available, including (product type, description, characteristics, features, prices, discounts, etc.) The Service Providers provide data, and the Platform assumes no liability arising from intentional or unintentional errors in such data.
(12) The client shall independently check all data provided through the platform, and the customer may contact the service provider directly to inquire about the available data.
(13) The Platform makes no warranties on the Service Provider’s or Merchant’s obligation to provide the declared pricing, offers, or discounts.
(14) The client knows and agrees that offers, discounts and prices may be linked to a specific duration or quantity; therefore, such offers may be removed at any time.
(15) The Service Provider or the Store supplies the Products, the Platform does not interfere with the delivery of the Products, either directly or indirectly, and the Platform accepts no legal liability if the Products are damaged, corrupted, illegal, or do not conform to the Declared Description.
(16) The Platform shall have no legal liability for any damages caused by the Products to the Client or any other persons, and the Client shall have no right of recourse to the Platform for any claims or damages.
Eleventh: Sales Policy
(1) The Platform is only intended for viewing and communicating between the Parties via the Platform, any sales, receipt, and delivery outside of the Platform shall be done by direct agreement between the Service Provider and the Client, with no interference or mediation from the Platform.
(2) For client safety, the Service Provider shall explain to the client all terms of sale through offers and advertisements made through the Store, including product characteristics, payment method, delivery, and recall or replacement of the Products.
(3) The Service Provider shall comply with all Applicable Laws and conduct sales in accordance with the conditions previously disclosed to the Client.
(4) The Platform is not liable to the Service Provider for any faults committed by the Service Provider, whether intentional or unintentional and is not liable to the Service Provider for any payments, delivery, or reception.
(5) The Service Provider bears all liabilities, compensation, and fines for the items it supplies to the Client, whether for illegality, invalidity, faults, lack of conformity, or the Service Provider’s failure to apply any conditions or laws in force.
Twelfth: Terms & Conditions for Service Providers
(1) The Service Provider warrants that it conducts business in accordance with applicable laws and regulations and that it has obtained all necessary permits and licenses to engage in e-commerce and enter into this Agreement with the platform of the Ajmal Zafaf. The Service Provider undertakes to keep all documents indicative of this.
(2) The Service Provider warrants that all information, photos, and files relating to the Services and Products given by it are true, accurate, and lawful and accurately portray the Service Provider’s Services and Products.
(3) The Service Provider shall ensure that no incorrect or misleading information about its Services or Products is posted and that the Services and Products are supplied in a commercially legitimate manner.
(4) The Service Provider shall guarantee that it has all legal rights and powers to sell the Services and Products and that it has obtained all relevant licences to sell the Services and Products.
(5) The Service Provider shall ensure that no third-party legal actions hinder the Client’s ability to access or dispose of the Services and Products.
(6) The Service Provider warrants that no third-party right shall attach to the services or products offered for booking through Ajmal Zafaf’s platform. The Service Provider undertakes to deliver the services and products to the Client on the agreed-upon delivery date. The delivery shall be carried out professionally under the provisions of this Agreement, and the Service Provider warrants that the services and products shall be free from apparent and hidden defects.
(7) The Service Provider undertakes to keep the Client’s contact information safe and not to use it in violation of the Ajmal Zafaf Platform’s Privacy Policy.
(8) If the Client violates any of the Service Provider’s rights, the Service Provider acknowledges that we have no business partnership, legal representation, agency, or other relationship with the Client. The Service Provider shall handle all legal matters independently of us or to us.
(9) The Service Provider accepts that it is not an employee of us, nor is the Platform an employer and that we have no supervisory power over it. It operates on its responsibility, with no contractual or legal liability to us.
(10) The Service Provider acknowledges that the Platform does not represent him before third parties, nor are we agents for him and that it is personally liable in the eyes of its clients in the event of a breach of the bilateral contract or the terms and conditions stipulated in this Agreement, or in the event of a violation of the legal provisions in force in the country whose law and jurisdiction is competent to resolve the dispute that arises between the Client and the Service Provider.
(11) The service provider is required to clearly announce the prices of services and products through the Ajmal Zafaf platform and to adhere to those prices declared in his relationship with the client, and non-compliance with the prices announced results in the termination of the contract between us, as well as the suspension of his membership in the Ajmal Zafaf platform, with our right to forfeit him the necessary amounts of money, and the client’s right to terminate the contract.
(12) Term and Termination: This Agreement shall take effect upon completion of the initial registration process for the Store and shall remain in force and effect for as long as the Service Provider is listed as part of the Ajmal Zafaf platform’s services, and either Party may terminate this Agreement at any time.
Thirteenth: Client’s Terms & Conditions
(1) If the client is a person, he must have the legal capacity to enter into purchase contracts.
(2) The client is the primary and ultimate administrator of the account linked with his data and is responsible for any illegal or unauthorized use of his account on Ajmal Zafaf’s platform.
(3) The Client shall comply with all Ajmal Zafaf platform policies, including governing the offering, selling, payment, shipment, and retrieval.
(4) The Client shall comply with all applicable laws, ordinances and regulations. The Client is also dedicated to treating the Service Provider with respect. The Client is permitted to make sales evaluations, and the Client agrees not to misuse this right and that the evaluations will be honest and the service’s performance representative.
(5) The Client acknowledges that we are not employees and have no supervisory responsibility over service providers or users and that they are independent in their work.
(6) The Client shall receive all services advertised on the Ajmal Zafaf platform at his own risk, and he shall follow all policies and instructions issued to him by the Service Provider, as well as the agreement established between him and the Service Provider.
(7) The Client purchases all promoted products through the platform of Ajmal Zafaf under the policies of the product suppliers and must adhere to the product usage policies.
(8) The Client knows that the Ajmal Zafaf platform does not provide any warranty services for the services and products sold, that warranties vary from one service or product to another and from one service provider to another, and that the Client must communicate directly with the service providers in the event of a warranty request for services or products.
(9) The Client acknowledges that the Platform does not represent him before the Service Provider, nor are we agents for him and that it is personally liable in the eyes of its clients in the event of a breach of the bilateral contract or the terms and conditions stipulated in this Agreement, or in the event of a violation of the legal provisions in force in the country whose law and jurisdiction is competent to resolve the dispute that arises between the Client and the Service Provider
Fourteenth: Bilateral Contract
If the Service Provider and the Client agree to purchase any of the services or products advertised on the Platform, a bilateral contract will be formed between the Service Provider and the Client, and the Platform will not be a party to this Contract, and its parties agree on all terms and guarantees, and our role is limited to making the content available through the Platform only, and the Platform does not provide any guarantees.
Fifteenth: Third Parties
(1) The Platform may help us supply our Services to third parties, and the Platform disclaims any direct or indirect, intentional or unintentional errors made by third parties who provide the Services through the Platform.
(2) The User may be subject to third-party terms and conditions that are beyond our control; thus, the User must study and agree to these rules before using third-party services supplied by us.
Sixteenth: Services’ Terms and Conditions
(1) The service provided through the platform must be Ajmal Zafaf in the scope of party services.
(2) The Service Provider must explicitly identify the service it delivers through the Ajmal Zafaf platform and specify what it will provide to the Client. The service provider is committed to advertising service pricing on Ajmal Zafaf’s platform and honoring the prices announced in his relationship with the Client.
(3) Party’s services must be permitted in line with existing laws, and no service may be provided if it is prohibited by law, adverse to custom, or contrary to public order or morals in the State.
(4) The premises where the Services will be performed shall be provided in accordance with the specifications agreed upon by the Client and the Service Provider, and the Service Provider must rigorously adhere to the dates and not create any delays for any reason. In order to meet the client’s aspirations of the service, specialized people must be utilized to implement the services and the proper appearance in the best way possible, and the devices and tools used must be in good condition and suited for the event.
(5) It is prohibited to offer counterfeit or stolen services or tools that the service provider does not have the legal authority to offer, that have financial rights to others or to offer services that breach others’ intellectual property rights, commercial rights, or privacy rights.
(6) The Ajmal Zafaf platform allows service providers to give discounts on their services, and the service provider is committed to the pricing mentioned in the offers published by him on the Ajmal Zafaf platform.
(7) Service providers make their advertisements and services available through the Ajmal Zafaf platform at their own risk, with no liability to us. Service providers who publish advertisements on Ajmal Zafaf’s platform are committed to the truth and integrity of their advertisements. Service providers undertake to avoid false, misleading, or unlawful advertisements.
(8) The Ajmal Zafaf platform assumes no liability for the content’s publication, and we are not liable if the service provider violates any third-party rights, which are solely the responsibility of the service provider.
Seventeenth: Products’ Terms and Conditions
The provision of party services available through the Ajmal Zafaf platform requires the provision of certain products, such as meals, restaurant products, sweets, and other products agreed upon between the customer and the service provider, and the service provider is committed to the products under the following conditions:
(1) Products sold through the Ajmal Zafaf platform must comply with the description of services/products in Section I of the Terms and Conditions, and they must be lawful, legitimate, and authorized to sell under applicable laws, and the service provider must get licenses to sell them.
(2) The service provider agrees not to offer, supply, promote, or advertise any false, corrupt, or misleading products that could cause harm to the Client if consumed.
(3) The Service Provider undertakes to affix a label comprising data about the kind, nature, ingredients, product name, date of manufacture or packaging, net weight, country of origin, and expiration date to the packaging or packaging of the Products.
(4) The service provider undertakes to advertise the prices of the products on the Ajmal Zafaf platform, including any applicable VAT, and to record this price on the products when they are delivered to the Client. The Client may request an invoice for the products purchased from the service provider.
(5) The Service Provider guarantees that the Products delivered to the Client will meet the standards specified on the Ajmal Zafaf platform.
(6) The Service Provider undertakes to comply with public health and safety regulations, and the products sold through the Ajmal Zafaf platform must comply with consumer protection laws.
(7) It is prohibited to sell intoxicating or narcotic substances, as well as substances that stimulate gambling. It is also illegal to offer items whose possession is a criminal offence. It is also unlawful to sell medications or tablets using the Ajmal Zafaf platform.
(8) The service provider shall be fully liable for the illegality of the products provided for sale through the Ajmal Zafaf platform and shall face all legal consequences if these products breach the requirements of this policy or the provisions of the laws in force.
(9) The Service Provider shall be entirely liable for the non-validity of the Products, as well as any damages emerging from the handling of the Products, without any liability on the platform of Ajmal Zafaf.
(10) The Service Provider shall comply with its Product Return Policy as well as the terms of any applicable consumer protection laws.
Eighteenth: Leasing Policy
(1) The Service Provider shall submit service rental advertisements directly or through a legally authorized representative on its behalf, the Client must review the details of the advertisement before submitting a rental application, and the rental process must be carried out under the conditions specified by the Service Provider in the advertisement.
(2) The data for the rental services must be specified by the service provider.
(3) The service provider is required to attach photos of the services so that the client can see them, and the images must be honest and not misleading to the client. The service provider is committed to allowing the client to inspect things or places, and the service accessories must be proven and signed by the customer after receiving them and must remain in trust until they are delivered to the service provider again.
(4) The Client and the Service Provider shall agree on the date of the booking and the number of days of the lease, and the Service Provider must deliver on time, while the Client shall return the items within the time frame provided.
(5) The Client shall utilize the Products and Services in accordance with the bilateral contract, the law, and the good faith principle.
(6) The Service Provider is exclusively liable for the unsuitability of the Services and items for use or their inability to perform the stated functions.
(7) The Client shall comply with the Service Provider’s Product and Services Return Policy as well as any applicable consumer protection legislation.
Nineteenth: Payment Policy
(1) The Platform does not offer any payment services for the Products or Services.
(2) Payment is made in accordance with service providers’ and advertisers’ policies.
(3) The Platform does not receive any fees, and the Client pays directly to the Service Provider, so:
- The Platform assumes no liability in case of an error in the payment process.
- The Platform provides no guarantees about the Client’s access to the Services or Products in exchange for payment.
- The Platform makes no refund assurances.
Twenty: Shipping Policy
(1) The Platform does not offer any shipping service for the Products.
(2) Products are shipped in compliance with the policies of the Service Providers.
Twenty-one: Return Policy
(1) The Platform does not provide any product recall or replacement services.
(2) Products shall be retrieved and replaced in line with the retrieval and replacement rules of the Service Providers.
Twenty-two: fees and Subscriptions
Platform Services are supplied to Service Providers in exchange for a commission and/or a Subscription to the Platform based on the plans or subscription pricing defined by Platform Management. You agree to the following by entering into this Agreement with us:
(1) The value of the Subscription may fluctuate from time to time, and the Site has the right to make modifications at any moment without your agreement.
(2) The Subscription shall be paid using any electronic payment method permitted by the Platform.
(3) By paying for the Subscription, you agree to all of the terms and conditions of this Agreement.
Twenty-three: Terms and Conditions of Evaluations
Clients may review the services and goods obtained from service providers, and service providers may respond to these evaluations, provided that these evaluations and responses are as follows:
(1) Evaluations must be true, non-false, and in suitable words, and clients must avoid insulting service providers or using inappropriate phrases.
(2) Service providers’ responses to client ratings must be honest, non-false, decent, and non-offensive, and must accurately reflect the service offered to clients.
(3) It is prohibited to interfere with, hurt, or otherwise misuse names, persons, institutions, companies, or symbols during assessments or responses, as well as to use religious slogans or statements that are offensive to cultures or peoples or opposed to the established order.
(4) In all cases, the “Ajmal Zafaf” platform shall not incur any liability in view of the truth of assessments or replies and their legality and we shall not incur any liability for illegal assessments and replies for which those who wrote them shall be liable.
(5) The Ajmal Zafaf Platform has the right to review and delete any illegal reviews or comments, as well as suspend or cancel the offender’s membership; failing to remove illegal reviews and responses does not imply our participation or approval to publish. Our right to review the assessments and replies must not be understood to be a legal obligation lying to us and you have to report to us in case of the existence of illegal assessments or replies to take suitable action for them.
(6) The Ajmal Zafaf Platform shall reserve its rights to refuse to publish any assessments or replies at any time in case they conflict with the preceding provisions.
(7) We reserve the full right to take legal action and seek all appropriate compensation if the evaluations and reactions cause damage to our Platform, while the injured and the community maintain the right to criminal penalties.
Twenty-four: Copyright
(1) The Platform of Ajmal Zafaf and the ideas expressed within it are our intellectual property rights. Any tradition or quotation of the Platform or some of its services (including ideas, texts, symbols, and software) is a violation of our copyright, and we will take all legal actions against the perpetrator of the aforementioned violations.
(2) All contents contained on or available through the services of the “Ajmal Zafaf” platform, including (text, logos, images, graphs, audio recordings, button icons, digital content, reloaded materials, software, and data collection), all are the property of the “Ajmal Zafaf” platform and it is secured by the copyright laws internationally as well as by Saudi Arabian.
(3) The collection or availability of all data included in the “Ajmal Zafaf” service by any of our services is the sole and proprietary property of the “Ajmal Zafaf” platform. And this is protected under Saudi and international copyright laws, as well as relevant international treaties such as the Berne Convention and the TRIPS Agreement.
Twenty-five: Trademarks/Brands
(1) “Most Beautiful Wedding” and “Ajmal Zafaf” and associated logos are our registered trademarks or/and our services marks.
(2) The “Ajmal Zafaf” platform’s trademarks and commercial designs include images, logos, page headers, button icons, texts, and service names.
(3) Without our written permission, it is prohibited to replicate the trademarks or commercial designs of the “Ajmal Zafaf” platform in any media or advertising medium.
(4) The trademarks and designs of the “Ajmal Zafaf” platform may not be used in connection with any product or service that is not ours. To protect the value and credibility of the “Ajmal Zafaf” platform and its clients.
(5) The Platform shall have the right to use the Service Providers’ Trademarks to market their Services, and the Service Provider shall have the right to use the Platform’s Trademark to market its Services and products supplied through the Platform, subject to the following conditions:
- The trademark may only be used for the marketing and promotion of services and products.
- The trademark shall be used legally without being abused or imposing any financial or legal responsibilities on its owner.
- Whoever abuses the trademarks permitted for use in the platform’s services is liable for all legal ramifications and restitution.
Twenty-six: Content Terms and Conditions
(1) The user acknowledges that He has full authority to post the Content on the Ajmal Zafaf Platform and that such Content does not violate any third-party rights.
(2) The Users shall bear all legal liabilities if They infringe on any personal or intellectual property rights in any Content it publishes via the Platform.
(3) Users that post advertising on the Ajmal Zafaf platform commit to truth and credibility in the display of their ads and agree to avoid false, misleading, or unlawful ads.
(4) The Ajmal Zafaf platform assumes no liability for the content’s publication, and we are not liable if the User violates any third-party rights, which are solely the responsibility of the User.
(5) The Ajmal Zafaf platform assumes no liability for content misuse, which is the duty of the user who misuses the content. In this situation, the user is accountable to confront us for his use of the Ajmal Zafaf platform’s content.
(6) Users grant us permission to view and share the Content it has made available through the Ajmal Zafaf Platform.
(7) The Platform reserves the right to remove any content published by the user via the Ajmal Zafaf Platform at any time if we feel that such content violates the third-party intellectual property, trademark, privacy, trade, or other proprietary rights.
(8) We reserve the right at any time to put the name “Ajmal Zafaf” on the content you have provided via the platform of Ajmal Zafaf.
Twenty-seven: Licenses granted
(1) The Ajmal Zafaf Platform provides you with a limited, non-exclusive, non-transferable, non-sublicensable license to access the non-commercial use of the Ajmal Zafaf Platform’s services by complying with the Terms of Use or any Terms of Service and by paying any relevant fees.
(2) This license does not permit the resale or commercial use of any of our Services or their contents, nor does it permit the making of copies of account information for the benefit of third parties or the use of data extraction techniques or similar data-collecting and extraction tools.
(3) You may not replicate, duplicate, copy, sell, or resell any portion of the Ajmal Zafaf platform or otherwise use it for commercial or non-commercial exploitation without the express written approval of the Ajmal Zafaf platform.
(4) You may not use any descriptive signs or other “hidden text” that exploits the name or trademarks of “Ajmal Zafaf” without the prior written approval of Ajmal Zafaf’s platform.
(5) You may use our Services only in a legally acceptable manner and in accordance with the provisions of this Agreement.
(6) If you do not comply with these Terms of Use or any other Terms of Service, we shall terminate the granted licenses to you.
(7) All rights not expressly granted to you in these Terms of Use or any other terms of service maintained by the Ajmal Zafaf Platform are reserved.
Twenty-eight: Communications
(1) You consent to receive communications from us. We will contact you through mobile number and by publishing notifications on the Ajmal Zafaf platform or other “Ajmal Zafaf” platform services.
(2) You consent that all agreements, notifications, disclosures, and other communications we deliver to you electronically satisfy all legal requirements as if they were in writing and that their legal consequences are substituted for their production.
(3) The Ajmal Zafaf Platform requires your approval during the registration process for us to send promotional messages to your mobile phone or through the Ajmal Zafaf Platform to inform you of any new modifications, features, or activities introduced to the Ajmal Zafaf Platform.
(4) If you decide at any time that you do not want to receive promotional messages, you may opt out of receiving these messages by emailing us, but in this case, we do not guarantee that you will enjoy our services in complete form.
Twenty-nine: Notifications
(1) Any notifications you want to send to the “Ajmal Zafaf” platform must be sent via the specified means within the Ajmal Zafaf platform, and any notifications sent outside the Ajmal Zafaf platform are irrelevant.
(2) Any notifications that the “Ajmal Zafaf” platform wants to send to you, either by advertising them on the platform of the Ajmal Zafaf or by sending them to you via the mobile number that you provided to us during the registration process. You are expected to know the notification as soon as the announcement is made on the Ajmal Zafaf platform or as soon as 5 minutes have passed since the message was sent to you.
Thirty: Rights and Obligations Transferring
(1) The Ajmal Zafaf platform may transfer all of its rights under this agreement to third parties without the user’s consent, and everyone is obligated to implement all of their obligations under this agreement by the assignee immediately upon notification of the transfer, and the assignee has the right to take all legal actions prior to the failure to implement its obligations under this agreement.
(2) Without our written consent of us, you may not subcontract your obligations and rights under this Agreement or entrust the operation of your account on the Ajmal Zafaf Platform to a third party.
Thirty-one: Amendments
(1) The “Ajmal Zafaf” platform reserves the right to change the terms and conditions and privacy policy at any time it deems appropriate, and the user must see these amendments before continuing to use the platform, and we will notify the user via the appropriate means, and we will update the “date of last update” at the top of this document.
(2) Your continued use of the Platform following such changes will indicate your acceptance of the changes to the Terms and Conditions and the Privacy Policy, whether by adding, deleting, or changing.
(3) We reserve the right to make changes or improvements to the Platform and its Services at any time in order to increase their effectiveness. The User agrees to follow any directions or instructions provided by the Platform in this regard, and such changes do not need the provision of any notices or notices to the User.
(4) The “Ajmal Zafaf” platform has the right to change the current and future charge and subscription plans without the approval of any of the platform’s users, and the new fee plans take effect immediately after the platform changes them.
Thirty-two: Cancellation of the Agreement
The agreement shall be automatically rescinded, without excuses or judicial procedures in any of the following cases:
(1) In case your breach of any paragraph or term of the terms of this agreement above mentioned is proved while reserving all our rights to claim compensation for the damages resulting therefrom.
(2) Assigning or subleasing the account without our consent.
(3) The non-performance by the user of any obligations provided for this agreement without taking serious actions to eliminate this breach while reserving our rights to claim compensation if necessary.
(4) Failure to document any information you’ve given us.
(5) If we determine that your activities may result in legal difficulties for you or other users.
(6) The Ajmal Zafaf platform is no longer active, or those in charge of operating the Ajmal Zafaf platform are no longer active.
Thirty-three: Liability
(1) You expressly agree that you use the Ajmal Zafaf Platform at your own risk.
(2) You are responsible for maintaining the Ajmal Zafaf platform’s seriousness and credibility, and you are liable to compensate for any losses or damages that may occur as a result of any illegal or unauthorized use by us.
(3) Users provide us with information and data under their own personal responsibility and so carry civil and criminal liability if such data is stolen, not registered in their names, or belongs to someone else.
(4) You acknowledge your entire legal liability in the event of a breach of any of the provisions of this Agreement, and you agree that we have the right to take whatever action we see fit against you, including suspending or cancelling your membership or taking you to court.
(5) You undertake not to use the “Ajmal Zafaf” platform or any service supplied via it in any way that is illegal, fraudulent, or antisocial, as we value.
(6) You undertake not to transmit any emails that are racially discriminatory, offensive, defamatory, vulgar, obscene, or otherwise improper.
(7) Without reference to us or us, the aggrieved party who has suffered harm as a result of a breach of any of the parties to this Agreement shall take all necessary legal measures against the perpetrator of the unlawful act. The aggrieved party must notify us of the breach in order for us to take action inside the Ajmal Zafaf platform, either by suspending or permanently banning membership.
(8) The penalties imposed by the Ajmal Zafaf platform on the parties to this Agreement shall not prejudice each party’s right to take all legal actions it deems suitable in its judgment without reference to us in any way, and no liability on the Ajmal Zafaf platform.
(9) You undertake to indemnify, hold harmless, and defend the Ajmal Zafaf Platform against any and all claims and demands made by third parties as a consequence of your use of the Platform, your violation of these Terms and Conditions, or your violation of the rights of other users.
(10) The “Ajmal Zafaf” platform does not guarantee that it will take action against all violations of this usage agreement that may arise, and our mission to take legal action in any case of violation does not waive our right to take such action at any time we think appropriate.
(11) You shall comply with all laws and regulations in force in the Kingdom of Saudi Arabia in connection with your use of the Platform, and you agree to accept all responsibilities that arise as a result of your violation of such laws or regulations, as well as all terms and conditions outlined in this Agreement.
(12) As a user, you are prohibited from providing any links to other apps or websites inside the Ajmal Zafaf platform that involve malware or viruses or are aimed at any fraudulent operation or electronic hacking operations.
(13) You are prohibited to interfere in any way with the operation of the Ajmal Zafaf platform or the advancement of work inside it or to declare in any manner that you represent us contrary to fact and reality.
Thirty-four: Our Liability Limits
(1) We provide our services “as is” with no express or implied representations or warranties of any kind relating to the use of the Ajmal Zafaf platform, its content, or the services provided. The Ajmal Zafaf platform does not guarantee the quality of the services and products provided by the service providers, which is solely the responsibility of the service providers.
(2) The Ajmal Zafaf platform is not liable for any personal acts or violations of privacy rights that may arise during the supply of services. The client accepts and understands that the Ajmal Zafaf platform is limited to allowing service providers to display their services and products only through the Ajmal Zafaf platform.
(3) Because the Ajmal Zafaf platform does not promise that the services or products will satisfy all of the client’s expectations when used, the Client accepts them as they are at the time of purchase.
(4) If the Client purchases a lot of services and products intending to resell them, the Ajmal Zafaf platform does not guarantee the Client’s capacity to advertise these services and products, their popularity, or profit from their resale.
(5) The platform of the Ajmal Zafaf excludes from its warranties, terms, and conditions any financial losses that the customer may suffer, defamation, or any special damages arising from your misuse of the services, products, or platform of the Ajmal Zafaf. The platform of Ajmal Zafaf bears no responsibilities or claims in such cases.
(6) The Ajmal Zafaf platform does not guarantee that technical defects will be fixed, or that the Ajmal Zafaf platform or its servers are free of viruses or anything else that is harmful or destructive, and you accept that online platforms are always prone to data corruption, unavailability, or delayed appearance.
(7) Due to repair, maintenance, or development, the Ajmal Zafaf platform may be unavailable from time to time, and you agree that the Ajmal Zafaf platform is not bound to provide technical assistance at any time.
(8) The Ajmal Zafaf platform will not be liable for any direct, indirect, or consequential loss, loss of profits, goodwill, or damage of any kind as a result of the exposure of your username and/or password.
(9) The “Ajmal Zafaf” platform makes no warranties that the platform, servers, or communications sent are free of viruses or other potentially hazardous components.
(10) The “Ajmal Zafaf” platform is not legally liable for any losses or damages resulting from the use of the Ajmal Zafaf platform, including but not limited to direct and indirect damages.
(11) The “Ajmal Zafaf” platform makes no warranties and accepts no duty for the newness, popularity, correctness, or quality of the information received by the User or accessed through the Ajmal Zafaf Platform.
(12) It is solely the user’s responsibility to use or depend on the information received or obtained through the services of the “Ajmal Zafaf” platform.
(13) You acknowledge that the “Ajmal Zafaf” platform is an Internet-based service, and that, while we have made every effort to keep the information secure, we cannot guarantee that the information received or broadcasted by the user while using the platform will be secure at all times.
(14) The “Ajmal Zafaf” platform cannot certify that every user is the person they claim to be.
(15) We may change, discontinue, or terminate the Ajmal Zafaf Platform’s services at any time without notice to you, and we may terminate your use of our services if you violate these terms and conditions or misuse our services in our opinion.
(16) The Ajmal Zafaf Platform and its officers and employees will not be liable to you or any other person for any direct or indirect loss or cost arising out of or in connection with the execution of the Usage Agreement or the provision of our services.
(17) The User is responsible for protecting, defending, and indemnifying the Ajmal Zafaf Platform and its employees against any losses resulting from any claim or demand connected to the Ajmal Zafaf Platform or resulting from the work or carelessness of the User, its representatives, or agents.
(18) Without limiting any other rights, the “Ajmal Zafaf” platform reserves the right to suspend or revoke your membership or access to the Ajmal Zafaf platform at any time and for any reason and to cancel this User Agreement.
(19) The Ajmal Zafaf platform does not guarantee that the services or portions of it will work on all mobile devices. For the devices on which the Ajmal Zafaf platform operates, there may be delays or malfunctions owing to an Internet flaw, for which you release us from liability.
Thirty-five: Sanctions
(1) Violation of any of the Service Provider’s terms and conditions, or any of the terms and conditions of the “Ajmal Zafaf” platform, including (failure to adhere to the declared prices, failure to adhere to the implementation dates, failure to adhere to providing the service), will result in the suspension of the Service Provider’s membership in the Ajmal Zafaf platform, with a fine for the amounts necessary to compensate us and the Client.
(2) Without referring to us, the Client shall have the right to sue the Service Provider in any circumstances where it breaches its contractual responsibilities outlined in these Terms and Conditions.
(3) The Platform has the right to sue the Service Provider and deduct any funds owed to it if it breaches its duties to us or our partners, contractors, employees, or affiliates.
Thirty-six: Applicable Law and Competent Courts
(1) This Agreement is governed by the laws of the Kingdom of Saudi Arabia.
(2) Any dispute arising from the interpretation or implementation of the contents of this Agreement shall be resolved by the judiciary of the Kingdom of Saudi Arabia.
(3) If any provision of this Agreement becomes invalid, illegal or unenforceable, the validity and enforceability of the other provisions of this Agreement shall not be affected.
Thirty-seven: Language
(1) The Arabic version of this Agreement shall be deemed to be the text used in interpreting and implementing its terms and conditions.
(2) In the event that there is an inconsistency between the Arabic and the foreign text of the offers, the Arabic text shall be taken as the original.
